By using CreateMyBrand, you agree to these Terms.

 

1. Our Service

CreateMyBrand is an online AI-powered platform for creating brands, logos, graphics, marketing materials, and other creative content.

We continuously develop and improve the service, so its features may change, expand, or be replaced over time.

 

2. Your Account

You are responsible for keeping your account secure.

Do not share your login credentials and use a secure password.

If you suspect that your account has been compromised or used without your authorization, please contact us as soon as possible.

 

3. Your Content

Content that you upload to CreateMyBrand remains yours.

You grant us permission to process your content only to the extent necessary to:

  • provide the service,

  • store your projects,

  • generate AI outputs,

  • create exports,

  • provide customer support.

We do not use your data to train our own AI models without your consent.

When we use third-party AI or cloud service providers, the data necessary to provide the requested service may be processed by those providers. For more information, please see our Privacy Policy.

 

4. AI Outputs

CreateMyBrand uses generative artificial intelligence.

AI can make mistakes, and similar or identical outputs may also be generated for other users.

Therefore, we cannot guarantee that outputs will be:

  • error-free,

  • unique,

  • legally protectable,

  • suitable for a particular purpose.

We recommend reviewing all outputs before using them.

 

5. Who Owns the Outputs?

Content created using CreateMyBrand may be used for both personal and commercial purposes.

We do not claim ownership of your brands or any content you upload to the service.

However, we do not guarantee that a generated logo, name, graphic, or other output does not infringe the rights of third parties, or that it can be registered as a trademark or otherwise legally protected.

You are responsible for verifying any relevant third-party rights before using an output commercially.

 

6. Credits and Subscriptions

Some CreateMyBrand features use credits.

The credit cost of a feature is displayed before you use it.

Credits:

  • are not money or electronic currency,

  • cannot be exchanged for cash,

  • cannot be transferred between accounts unless we explicitly state otherwise.

The validity and rollover of credits are governed by the terms of the specific plan or offer shown at the time of purchase.

Paid subscriptions automatically renew for the next billing period until cancelled.

You may cancel your subscription at any time. Cancellation takes effect from the next billing period, and you may continue using the service until the end of the period you have already paid for.

The current price is always displayed before purchase. Any future price change will not affect a billing period that has already been paid for.

 

7. Withdrawal and Refunds

If you are a consumer, you have the right to withdraw from the contract in the circumstances and within the time limits provided by applicable law.

If you request immediate access to digital content or services before the statutory withdrawal period has expired, your right of withdrawal may expire where permitted by applicable law.

Otherwise, purchased credits and subscription fees already paid are non-refundable unless required by law or stated otherwise in the specific terms of an offer.

 

8. Complaints

If the service does not work as expected, please contact us at hello@createmybrand.net.

We will do our best to resolve the issue as quickly as possible. This does not affect any statutory rights you may have regarding defective digital content or services.

 

9. Prohibited Use

You may not use CreateMyBrand to:

  • violate applicable laws,

  • infringe the rights of third parties,

  • create fraudulent or harmful content,

  • distribute malware or other malicious code,

  • compromise or attempt to compromise the security of the service,

  • circumvent technical restrictions or credit limits,

  • abuse AI features,

  • copy or reverse-engineer the platform.

If you violate these rules, we may restrict, suspend, or terminate your account.

 

10. Beta Features

Some features may be labelled Beta or Experimental.

These features are provided for testing purposes and may contain errors, be changed, or be discontinued.

We do not guarantee their continuous availability or specific results.

 

11. Service Availability

We aim to keep CreateMyBrand as available and reliable as possible.

However, we cannot guarantee uninterrupted or error-free operation.

We may perform maintenance, deploy security updates, or release new versions of the service.

 

12. Limitation of Liability

CreateMyBrand is a creative tool powered by artificial intelligence.

You are responsible for the final decision to use any outputs generated through the service.

To the extent permitted by applicable law, můjBrand s.r.o. is not liable for business decisions made based on AI-generated outputs or for damages resulting from their use.

 

13. Account Termination

You may close your account at any time.

We may restrict, suspend, or terminate an account, particularly in cases involving:

  • violation of these Terms,

  • illegal use of the service,

  • abuse of AI features or the credit system,

  • threats to the security of the platform.

14. Changes to These Terms

We may update these Terms from time to time, for example as our service evolves or applicable laws change.

If we make significant changes, we will notify you by email or through a notice within the application.
